1. The challenge in the present writ petition is to the order of transfer dated 16.08.2019 whereby the petitioner has been transferred from Koriya Division Manendragarh to Division Bijapur.

2. Contention of the petitioner is that husband of the petitioner is the employee of the Coal Mines working at Manendragarh, who cannot be transferred to a place where petitioner has been transferred to. Counsel for the petitioner submits that State authorities should have considered the claim of the petitioner and accommodate the

petitioner as far as possible at a nearby place, if at all if under the administrative exigency the petitioner had to be transferred.

3. Given the facts and circumstances of the case, particularly taking note of the fact of services of the husband of the petitioner, let petitioner make a representation to the respondent No.1 within a period of 10 days from today and on receipt of such representation the respondent No.1 shall decide the same within a period of 45 days.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed so far as the petitioner is concerned.

5. It is expected that respondent authority would consider the grievance of the petitioner sympathetically.
