Majid Ali, Advocate Hon'ble Shri P.R. Ramachandra Menon, Chief Justice Hon'ble Shri Parth Prateem Sahu, Judge Order on Board Per, P.R. Ramachandra Menon, Chief Justice 18/11/2019 1.
The Petitioner has moved this Court with the following prayers :- "1) That, this Hon'ble Court may kindly be pleased to writ/ writs, order/orders, direction/directions, quashing the impugned order dated 27.06.2019 (Annex. P/1) passed by Chief Conservator of Forest, Bilaspur Circle, Bilaspur, District Bilaspur (C.G.) and the respondent authorities may kindly be directed to consider the case of the petitioner and they may directed to afford one more opportunity to deposit the installment amount in respect of the instant purchase agreement.
2) That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstance of the case." 2.
It was pointed out from the part of the Respondents that not even a single installment was satisfied by the Petitioner, despite the several opportunities given. As per order dated 22.10.2019, the submission made on the part of the Respondents that they were still willing to accommodate the Petitioner, if one installment was satisfied and a fee of Rs.10,000/- was paid for renewal, in view of the assurance made from the part of the Petitioner that the entire liability will be cleared on or before 30.11.2019.
3.
When the matter came for consideration before this Court on previous occasions, time was sought for with reference to some medical emergency, which was acceded to, but, still the word given by the Petitioner is still to be proved by his deed. The fact remains that no amount has been satisfied by the Petitioner in spite of the magnanimity shown by the Respondents to accommodate him and the facility provided by this Court as per the interim order dated 22.10.2019.
4.
In the said circumstance, we are of the view that this is not a fit case to exercise our discretion to grant any relief to the Petitioner. There is absolutely no merit in this writ petition. It stands dismissed accordingly. Sd/- Sd/- (P.R. Ramachandra Menon) (Parth Prateem Sahu) Chief Justice Judge Chandra
