1. On due consideration delay of 446 days in filing of the MCC is condoned. Accordingly, I.A. No.01, application for condonation of delay is allowed.

2. This is an application for restoration of FAM No.18/2017,

MCC No. 1044 of 2019 which was dismissed for non compliance of the Court order dated 11.05.2018.

3. On due consideration and for the reasons mentioned in the restoration application, it is allowed and FAM No.18/2017 is directed to be restored to its original number subject to submission of paper book within one month.

4. In the event, records of the trial Court are not received within this time, applicant would be at liberty to pray for extension of time for filing paper book in the first appeal before the regular Bench.
