Challenge in this petition is to the order of termination dated 13.09.2018 passed by the Sub Divisional Officer (R) Saraipali, Distt. Mahasamund. Perusal of record would reveal that the order impugned is an appellable order and there is hierarchy of appeal provided under the relevant Rules and without availing the remedy of appeal the petitioner has rushed to this court challenging the impugned order.

Accordingly, reserving the right of the petitioner to prefer a departmental appeal against the impugned order, the present petition stands disposed of. On such appeal being preferred, the appellate authority would objectively consider the contentions raised in the appeal and decide the same at the earliest within the period prescribed under the rules.
