In view of the judgment of the Supreme Court dated 12th October 2018, in the matter of Mallikarjun Kodagali Vs. State of Karnataka (2018 (14) SCALE 32; 2018 (9) KLJR, 244), there is no necessity of moving application seeking leave to appeal when the person preferring the appeal is the victim himself/herself. This application has been preferred by the victim herself therefore, filing of Cr.M.P. is not necessary. Accordingly, Cr.M.P. is disposed of.

Let regular acquittal appeal be registered and the same be posted for hearing on the application for condonation of delay.
