This is the second bail application filed under Section 439 of Cr.P.C. The earlier bail application was dismissed on 15/12/2020 vide M.Cr.C. No.6556/2020.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.137/2020 registered in Police Station Shivrinarayan, District Janjgir Champa (C.G.) for offence punishable under sections 307, 147, 148, 149 of the IPC. 3.

As per the prosecution case, on 16/05/2020 the applicant alongwith other co-accused have assaulted one Swapnil Yadav over the dispute of land and Swapnil was found unconscious on 17/05/2020 and he was admitted to the hospital.

Learned counsel for the applicant submits that now the charge has been framed, therefore under the circumstances the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 6.

Considering the fact that simply because charge has been framed, I

do not find any change of circumstances to reconsider the bail as the earlier bail was dismissed on merits on 15/12/2020. 7.
