1. Heard.

2. Learned counsel for the petitioner would submit that the petitioner is working as Auxillary Nurse Midwife (ANM) at Chandrakhuri, District Durg. She is aged about 55 years and she has been transferred to Thengabhat, District Durg which is 58 kms away from her present place of posting. It is stated that the petitioner being a low paid employee, she will not be able to maintain herself, for transfer to such a distant place, which amounts to almost punishment. It is stated that the petitioner has already made a representation to Chief Medical Officer (CMO), Durg which may be decided.

3. Considering the position of the petitioner, the petitioner shall be at liberty to

make a fresh representation to the Secretary Department of Health with a copy to Chief Medical Officer (CMO), Durg within a period of three weeks, narrating all her grievances and if such representation is made by the petitioner to the State, the same may be decided within a further period of six weeks.

4. Considering the position of the petitioner, it is observed that if the transfer order in respect of the petitioner has not been carried out and no one has joined as on date in her place, she may be allowed to continue in her present place of posting till the representation is decided.
