1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.540/2017, registered at Police Station- Chakarbhata, District- Bilaspur(C.G.) for the offence punishable under Sections 186, 353, 294, 506 & 332 of the Indian Penal Code (for short 'IPC').
2. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in this case by the complainant because of animosity. The offence registered against this applicant are triable by JMFC. Applicant is in jail since 24.11.2017 and he is ready to abide by all the conditions and directions, which may be imposed while granting bail to him. Hence, it is prayed that applicant
Page No.2 be enlarged on regular bail.
3. Learned State counsel opposes the bail application and submissions made in this respect.
4. Heard both the parties and perused the case diary.
5. On the date of incident, the complainant Anil Kumar Lakra constable(Traffic) was on duty when the applicant was parking Hywa bearing Registration No.CG-10 AE/9700 on the main road, then the complainant stopped him for parking on that place, the applicant used abusive words for him and then he threatened and manhandled him by toaring his uniform. The FIR was lodged on that basis and the offence has been registered against this applicant.
6. Considered the nature of the offence that is alleged against this applicant and that he is in jail since 24.11.2017. All the offences are triable by JMFC. For these reasons, I am of this opinion that this is a fit case where applicant should be granted regular bail.
7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
