Learned counsel for the petitioner would submit that on the basis of complaint made against the petitioner, criminal case has been registered and departmental proceeding is pending against him. It is submitted that the petitioner may be allowed to make representation before the disciplinary authority to stay the departmental proceedings till the criminal case is finally concluded.

Be that as it may, the petitioner is at liberty to make representation before the disciplinary authority / competent authority for staying the departmental proceedings which shall be considered and decided by the concerned authority in accordance with law on its own merits within two weeks from the date of receipt of representation. 3.

It is made clear that this Court has not expressed any opinion on the merits of the case.
