The Counsel for the respondent submits that in due course, the order passed by this Court on 04.05.2018 has been complied with. According to the respondent, this Court, on 04.05.2018, had directed the respondents to clear the retrial dues of the petitioner within 90 days, failing which, the interest would accrue on the retrial dues. Details of the payment is reflected in Annexure R/3 enclosed along with the reply. 2.

The Counsel for the Respondent has made a statement that on 30.06.2018 that is in less than 60 days time, respondent had processed the claim of the petitioner and released an amount of more than Rs. 27,00000/- and the balance of amount Rs. 2,00000 was released in a further couple of months time. That meanwhile the respondent had filed an MCC i.e. MCC 756 of 2018 in which the respondent was granted 30

days time. further for releasing the balance of payment. With the aforesaid factual matrix of the case, this Court is of the opinion that the respondents in fact have complied with the order passed by this Court and no contempt further survives.

In the event, if the petitioner finds that the calculation is not proper, there are certain further dues payable to the petitioner. The petitioner would be at liberty to approach the authorities concerned, who in turn shall make all endeavor in scrutinizing the claim of the petitioner for releasing the balance of amount of any at the earliest. 4.

With the aforesaid observations, the Contempt petition stands disposed of.
