Sam Koshy Order On Board 03/05/2017 The present application under Section 438 of Cr.P.C. has been filed seeking for grant of anticipatory bail to the applicant apprehending his arrest in connection with Crime No.519/2016 registered at P.S. Janjgir, District Janjgir-Champa (CG) for the offence punishable under Sections 420, 409, 120B read with 34 of IPC.
Prima facie allegation levelled against the applicant on behalf of the prosecution is that the present applicant along with other accused persons are instrumental in releasing more than rupees thirty lakhs in connection with construction work which has never been undertaken. The gravity of the allegation levelled against the applicant and the other accused persons itself forces this Court to refuse to grant the benefit of anticipatory bail to the applicant.
Accordingly, the instant application filed under Section 438 Cr.P.C. stands rejected.
