Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 08-10-2017 in connection with Crime No.901/2017 registered at P.S. Supela, District Durg, Chhattisgarh for the offence under Section 20(B) of the N.D.P.S. Act. 2.
It is submitted on behalf of the applicant, that the applicant has been falsely implicated in this case. The applicant is local resident of District Durg. He is in jail since 08-10-2017. The co-accused person in this case has been granted regular bail by this Court in MCRC No.455/2018 vide order dated 1502-2018. Hence, it is prayed that the applicant may also be granted regular bail.

Learned counsel for the State/non-applicant opposes the application. 4.
Heard learned counsel for the parties and perused the case diary. 5.
On the date of incident a search was made by police personnel of P.S. Supela, Distt. Durg and 5 kg. Ganja, narcotic substance was found in possession of this applicant, which was seized and the case has been registered against this applicant and the co-accused person.

As it appears that the applicant is local resident of District Durg, coaccused person in this case has already been granted bail, I am of this view that the applicant should be enlarged on bail during pendency of the trial against him.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 9.
