When the matter is taken up for consideration, apart from the question of inordinate delay of 386 days in filing the appeal, the merit is also seriously disputed by the learned counsel representing the State that there is no merit as well.

The learned counsel for the Appellant seeks for permission to withdraw the matter, without prejudice to the rights and liberties to have the grievance redressed by other appropriate proceedings.
