This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.419/2016 registered at Police Station- City Kotwali, Dhamtari (C.G.) for the offence punishable under Section 392 of Indian Penal Code. 2.

Case of the prosecution, in brief, is that a report was made by Smt. Rukhmani Sahu alleging that the applicant on 08.11.2016 along-with others snatched the Gold chain while the complainant was walking on the road. Thereafter, the applicant was arrested. 3.

Learned counsel for the applicant would submit that the applicant has been falsely implicated and the charge sheet has been filed in this case and no further investigation is necessary, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the statement of the complainant wherein the applicant has been identified. Considering the statement of the complainant, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
