Mr. Sudhir Sahu, Panel Lawyer Hon'ble Shri Justice Goutam Bhaduri Order on Board 19.11.2019
1. Learned counsel for the petitioner submits that the petitioner has been transferred from Baloda Bazar to Simga by order dated 12.07.2019 and thereafter the petitioner had complied with the order and joined the transferred place. It is stated that in the transfer order dated 12.07.2019 (Annexure P-1) one Ashutosh Pradhan who was transferred from Simga to Baloda Bazar had filed a writ petition as both the petitioner and Ashutosh Pradhan wanted to get the transfer on mutual basis wherein the Court has ordered that the representation of the petitioner may be decided on merit. The said writ petition was bearing WPS No.8066 of 2019 and the orders were passed on 03.10.2019. This Court has passed the following orders :
"2. Given the fact that the petitioner's application for mutual transfer is pending consideration, without
expressing anything on the merits of the said application, the writ petition stands disposed of for the respondents to take a decision on the said application at the earliest in accordance to law."
2. It is contended that because of the pendency of this petition, the said representation cannot be decided. Considering the fact, it is directed that the application for mutual transfer filed by the petitioner may be decided at the earliest, in accordance with law.
3. With such observation, the petition stands disposed off. Sd/- (Goutam Bhaduri) Judge Ashok
