The petitioner is retired from service and now, he is seeking mandamus to add the name of his second wife as nominee in the service records which has been declined by the respondent authorities. 2.

Learned counsel for the petitioner submits that the first wife of the petitioner is not well, therefore, name of his second wife be added in his service records as nominee by issuance of appropriate direction. 3.

I have heard learned counsel for the petitioner, considered the

submissions made herein above and also went through the records with utmost circumspection.

After going through the records, I am of the view that no such direction can be issued to add the name of second wife of the petitioner as nominee in the service records during the life time and subsistence of his marriage with his first wife. Even otherwise, second marriage by the Government Servant during subsistence of first marriage without prior permission of competent authority is prohibited.
