1. The limited grievance of the petitioner in the present Writ Petition is for an appropriate direction to the Respondents to consider his claim for promotion from the post of Assistant Teacher Panchayat in

-2Physical Education subject to the post of Teacher Panchayat in the said subject.

2. According to the petitioner, while in service petitioner has already obtained the Degree of B.P.Ed, thereby he has become eligible for promotion.

3. Since the petitioner has already made a representation in this regard. Let the respondents decide the representation on merits at the earliest, preferably within a period of three months from the date of receipt of copy of this Order. However, this Court is not expressing any opinion, so far as the petitioner's eligibility is concerned.

4. The respondents, however, are also expected to consider, if the petitioner is eligible for promotion or whether he is in the zone of consideration for promotion, subject to his fulfilling the eligibility criteria and also seniority. The Respondents are expected to take a decision at the earliest.
