This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.92/2015, registered at Police Station - Rudri, District - Dhamtari (C.G.) for the offence punishable under Section 420 of Indian Penal Code and Section 66 (d) of I.T. Act.

The earlier bail application was dismissed as withdrawn vide order dated 28.06.2016 in M.Cr.C. No.2149/2016 with a direction to the trial Court to expedite the trial.

No order sheets have been placed before the Court to show that there has been a enormous delay in trial. Considering the fact that no liberty was given to the applicant to repeat the bail application again and in absence of any fact I do not find any change of circumstances, therefore, I am not inclined to entertain the bail application. 4.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
