1. This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court.

2. Perused the case diary provided by the learned counsel for the State in connection with the Crime No.167/2018 registered at Police Station Azad Chowk, Raipur, District Raipur (C.G.) for the offence punishable under Section 395, 397, 394 of IPC.

Case of the prosecution, in brief is that complainant Prashant Sharma was engaged to collect the sale amount from different liquor shop and deposit it in the office of Writer Safeguard Company Private Limited situated at Sunder Nagar. Intervening night of 14/07/2018 to 15/07/2018 he was coming to the said office to deposit the cash amount which was collected from different wine shop, which was Rs.31,22,950/- which was kept in the black bag of said Company. On the way six persons who came from four wheeler robed the aforesaid cash amount from the complainant and caused injury to him.

4. Learned counsel for the applicant submits that he has innocent and falsely implicated in the present case, therefore, he shall be released on bail.

5. On the other hand, counsel for the State opposes the bail application. He further submits that no criminal antecedents against the applicant.

6. As per the memorandum of applicant one Ertiga Car, one fake number plate, one black bag of the said company were seized from the possession of the applicant.

Looking to the facts and circumstances of the case, looking to the seriousness of the alleged offence, looking to the impact of granting bail to the applicant on society, the present bail application is rejected. Sd/- (Sharad Kumar Gupta) Judge Kamde
