This is second bail application filed under Section 439 of the Cr.P.C., for grant of regular bail to the applicant who has been arrested on 41-2016 in connection with Crime No. 356 of 2015 registered at Police Station Urga, District Korba (CG) for the offence punishable under Sections 420, 34, 467, 468, 471, 201 and 120(B) of the IPC. Earlier first bail application was dismissed on merits on 15-6-2016 2.

Case of the prosecution, in brief, is that the applicant in connivance with Vinod Khande and Kapl issued different appointment letters for the post of Data Entry Operator and the allegations against the prsent applicant are that he typed such appointment letters. Such appointment letters were issued after obtaining amount from different persons.

Learned counsel appearing for the applicant would submit that there is delay in trial, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail application.

I have heard learned counsel for the parties and perused the case diary and documents annexed to the bail application. 6.

Consideing the fact that earlier first bail application was dismissed on merit and no substantial delay appears to have been shown in the present case, I do not find any change of circumstances to reconsider the second bail application.

Accordingly, the second bail application is also liable to be and is hereby dismissed.
