Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 13/12/2017 At the outset, learned counsel for the parties jointly submit that the contempt petition may be disposed off because later on, upon spot inspection, it has been found that the construction is actually taking place only on the Government land and not on petitioner's land.
Learned counsel for the petitioner submits that the petitioner had to file this petition when lots of debris was found on petitioner's land which gave an impression of construction being made on petitioner's land. But after spot inspection made, the petitioner is satisfied that actually no construction has taken place on petitioner's land. Learned counsel for the petitioner submits that the debris which has been collected on petitioner's land is required to be removed by the construction agency. Learned counsel for respondent No.1 submits that he would suitably instruct his party for taking suitable steps.
The petition is accordingly disposed off.
