Learned counsel for the petitioner would submit that though by respondents have initiated the departmental proceedings and the criminal proceedings are also pending on the same set of evidence against which he has already moved an application for stay of departmental proceedings, which is pending consideration before the respondents which has not been not considered and decided till date, therefore, the respondents be directed to decide the application, in accordance with law.

Mr. N. Naha Roy, counsel for the respondents submits that the petitioners' application filed before respondent No.2 will be considered by the competent authority, expeditiously in accordance with law.

It is directed that the competent authority shall consider the said application filed by the petitioner for staying the departmental proceedings and decide the same within a period of three weeks' from the date of receipt of copy of this order, on its own merits, in accordance with law.

With the aforesaid observation, the writ petition finally stand disposed off.
