Hon'ble Shri Justice P. Sam Koshy Order On Board 15.12.2021
1. The petitioner seems to be aggrieved by the decision of the respondent No. 4 in so far as granting sanction for construction of a Gothan in the land bearing Khasra No. 1003 Village Asandih.
2. Considering the nature of dispute and the pleadings sought for by the petitioner, this Court is of the firm view that the writ petition for the said relief would not be maintainable. Moreover, it is a case where the petitioner himself is a Panch of Gram Panchayat Asandih and even the decision to construct the Gothan was that of the Gram Panchayat.
3. Given the fact that the writ petition would not be maintainable and it would be for the petitioner to approach the concerned authorities in the Local Administration to ventilate his grievance. Reserving the right for the same, the present writ petition at this juncture stands disposed of as not maintainable.
