1. No one appears for the respondent, despite service of notice.

2. It is argued by Shri Behar that the order passed in Writ Appeal No. 476 of 2015 was wrongly applied while deciding WPS No. 6434 of 2008, therefore, the order deserves to be recalled and the matter of writ petition be heard afresh.

3. A perusal of the order dated 17.04.2017 passed in WPS No. 6434 of 2008 as also the order passed in Writ Petition No. 476 of 2015 would reveal that there appears some discrepancy while dictating the operative part at the time of disposal of WPS No. 6434 of 2008, therefore, the said order deserves to be and is hereby recalled.

4. The review petition stands allowed.

5. WPS No. 6434 of 2008 be placed before this Bench day after tomorrow i.e. on 05.10.2017 for hearing.
