Heard on I.A.No.1/2017 for condonation of delay in filing the instant MCC as the instant MCC has been preferred after 214 days from the date of the order dated 11-11-2016 passed in WPL No.2110/2007 whereby the said WPL was dismissed for want of prosecution as the applicant/petitioner was not present.

Perused the documents annexed in support of I.A.No.1/2017 regarding return of brief by the earlier counsel of the applicant on the ground of ailment. 3.

On due consideration, this Court is of the considered view that the applicant had satisfactorily explained the delay of 214 days. Consequently, I.A.No.1/2017 is hereby allowed and the delay in filing the instant MCC is hereby condoned.

The matter is admitted for consideration.

The matter heard finally.

On due consideration, the instant MCC is hereby allowed and WPL No.2110/2007 dismissed for want of prosecution dated 11-11-2016 is restored

-2to its original number.

No order as to cost.
