1. Learned counsel for the petitioner would submit that the claim raised by the respondent - Union and the matter referred to the labour court by the appropriate Government is cognizable by the Chhattisgarh Industrial Tribunal in the light of Section 10(1)(d) of the Industrial Dispute Act.

2. Learned counsel for respondent No.3 would submit that no such objection has been raised before the appropriate authority. The petitioner is at liberty to raise objections by filing appropriate reply or statement.

3. Be that as it may, if the petitioner has not raised any objection before

the labour Court, he is free to raise such objection in appropriate reply by filing statement of claim before the Labour Court and the Labour Court is directed to decided the objection raised by the petitioner, expeditiously in accordance with law.

4. In view of the above observation, the writ petition stands disposed of. Sd/- (Sanjay K. Agrawal) Judge Kvr
