1. Mr.Devesh G. Kela, learned counsel for the petitioner, would submit that order of suspension passed by respondent No.2/Chief Executive Officer, Zila Panchayat, Rajnandgaon is contrary to law. At this stage, he would submit that against the order of suspension, appeal would lie before the appellate authority under Rule 15 of the Chhattisgarh Panchayat Service (Discipline and Appeal) Rules, 1999.

2. In that view of the matter, the petitioner is at liberty to prefer appeal before the appellate authority within 7 days from today. The petitioner is also at liberty to make

an application for grant of stay. If an application for grant of stay is preferred, the appellate authority shall consider and decide the same within next 10 days from its receipt. Till then for a period of 10 days, order directing change of headquarter from Gram Panchayat Chuikhadan to Janpad Panchayat Khairagarh shall remain stayed.

3. With the aforesaid observation / direction, the writ petition stands finally disposed off. No order as to cost(s).
