Learned counsel for the applicant under takes to file power to represent the applicant during the course of the day. Let appropriate power is required under the law be filed within the course of the day. 2.

Learned counsel for the applicant would submit that matter may be heard. Heard on IA No. 01/17 for condonation of delay to file MCC.

As the instant MCC has been preferred after 104 days of the order passed in Writ Petition 4472/06 dated 07/04/2017 as the said Writ Petition was dismissed for want of prosecution.

After perusal of the reasons mentioned in the IA No. 01/17 this Court is of considered view that preferring the instant MCC after 104 days of the order passed by this Court. Applicant had satisfactory ground. Consequently, IA No. 01/17 is hereby disposed of filing the instant MCC after 104 days of the order passed by this Court, is taken for hearirng.

Also heard the matter finally. Learned counsel for the applicant would submit that as the Respondent No.02 was not represented on 07/04/2017 when the said Writ Petition was taken for hearing, hence, the present matter may also be disposed of by not noticing the Respondent No.02.

On due consideration, matter heard finally. The instant MCC is hereby allowed Writ Petition No.4472/06 dismissed for want of prosecution on 07/04/2017 is restored to its original number. 7.
