Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 3/5/2017 .

1. Learned counsel for the applicant informed the court that as per the order passed by this Court dated 1-4-2017, the applicant has not surrendered before the trial Court on 1-5-2017

2. On earlier occasion also the applicant was granted temporary bail and he prayed for extension of period of temporary bail and presently also the applicant has not complied with the order passed by this Court in a circumstance submitted on behalf of the applicant.

3. On due consideration, MCRC filed by the applicant is dismissed on entirety of the matter.

4. The court below is directed to proceed under the provisions of law regarding appearance of the applicant and also directed to proceed against the surety and the applicant under Section 446 and other relevant provisions of Cr.P.C. for forfeiture and realization of the bail bond under intimation to the Registry.
