Grievance of the petitioner is that the petitioner who is working as Supervisor in Integrated Child Development Project, Sarkanda is carrying pregnancy of four months and was aborted in the previous pregnancy has been transferred from Sarkanda, District Bilaspur to Sahaspur Lohara, District Kabirdham by the impugned order dated 21/08/2019. It is contended that husband of the petitioner who is working as constable has been transferred in March, 2019 from Rajnandgaon to Bilaspur on the request that husband and wife should be kept at the same place, however the petitioner has been transferred to Sahaspur Lohara, District Kabirdham from Sarkanda, District Bilaspur. It is further submitted that this
transfer is in violation to the policy of the State as husband and wife are to be kept in the same place. It is further submitted that medical condition of the petitioner also do not permit her transfer to another place. 2.
Considering her pregnancy, document attached with the petition Annexure P-5 would show that the husband of the petitioner namely Durgesh Singh has been transferred from Rajnandgaon to Bilaspur on 10/03/2019. Document filed along with the petition shows that the petitioner is carrying pregnancy. Policy of the State is also attached which shows that husband and wife normally to be kept in same place. Considering the medical report of the petitioner and further taking into fact that husband of the petitioner was transferred to Bilaspur in the month of March, 2019 as per Annexure P-5, it is directed that the petitioner shall make a detailed representation within a period of three weeks from today to concerned respondent wherein she may narrate the entire facts. If such representation is filed, same may be decided within a further period of 90 days. Till then the transfer order dated 21/08/2019 of the petitioner shall not be given effect to.
