The present MCC has been filed seeking for restoration of WPS No. 30.10.2018 5709/2018 which got dismissed on account of peremptory order passed by this Court on 31.08.2018.

Counsel for the applicant submits that he has removed the default but the same could not be removed within the stipulated period which led to dismissal of the petition by virtue of peremptory order. Thus, prayed for restoration of the writ petition.

Given the facts and circumstances of the case, the present MCC deserves to be and is accordingly allowed and WPS No. 5709/2018 is restored to its original number.

No order as to costs.
