Hon'ble Shri Justice Gautam Chourdiya Order on Board 13.12.2021

1) The applicant has preferred this criminal revision under Section 397 read with 401 of CrPC against the order dated 23.11.2021 passed by the learned Additional Sessions Judge, Fast Track Special Judge (POCSO Act), Ambikapur, District- Surguja (C.G.) in Special Criminal POCSO Case No. 77/2019 whereby application u/s 311 of CrPC filed by the applicant, has been dismissed.

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this criminal revision and he wants to file application under Section 482 of CrPC and prays for return of certified copy of the impugned order.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the criminal revision is dismissed as withdrawn with aforesaid liberty.
