Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31/01/2017 This contempt petition has been filed alleging willful disobedience of interim order dated 04-08-2016 passed by this Court, which is said to have continued even thereafter and modified on 08-12-2016.

In the petition, it has been alleged that the selection list has been finalized, which is an act of disobedience.

Having gone through the order passed by this Court in W.P.(S)No.3390 of 2016 and the records of WP(S)No.3390 of 2016 attached with the records of contempt petition, particularly order dated 08-12-2016, it is misconceived on the part of the petitioner to allege that there is disobedience of Court's order. Though, initially an interim order was passed by this Court on 04-08-2016 that till the next date of hearing, procedure of selection may continue, but the selection list shall not be finalized, which was continued on subsequent dates, but ultimately vide order dated 08-12-2016, the interim order was modified subject to the direction that one post of Revenue Inspector be kept vacant. Therefore, there was no impediment in finalizing the selection

procedure and taking steps in pursuance to finalization of selection. There is no specific averment in the contempt petition that one post has not been kept vacant. 4.

In these circumstances, the contempt petition is misconceived and therefore, dismissed.
