Mr. A.K. Shukla, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/02/2017 Heard on admission.
1.
This contempt petition has been filed by the petitioners alleging willful disobedience of the order dated 20.06.2016 passed by this Court. 2.
Learned counsel for the petitioners submits that this Court directed the respondents to decide the matter within a period of three months after affording due opportunity of hearing to the petitioners. However, the steps were not taken to ensure expeditious disposal of the matter within a period of three months and vide notice dated 28.11.2016, the petitioners appeared before the authority on 01.12.2016 but thereafter, no order has been passed and the period of three months have elapsed long back. 3.
It appears that the time schedule within which the exercise was required to be completed, has not been strictly adhered to by the respondents. The spirit of the order required expeditious disposal. However, considering that the proceedings have already been started, the petitioners were called for hearing, they were heard and thereafter the order has not been passed till date, at this stage, instead of issuing notice, the respondents are directed to complete the exercise at the earliest without further loss of time keeping in view the spirit of the order dated 20.06.2016. If within a period of 60 days from the date of receipt of copy of this order, which is now being passed, no orders are passed, the petitioners would be at liberty to revive this petition. 4.
With the aforesaid liberty, the petition is disposed off. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
