Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/03/2017 Heard.

1. The petitioner had moved an application for issuance of direction for grant of compassionate appointment that petition was disposed off on 24.12.2014 directing the respondent No.3 Inspector General of Police Surguja Range Ambikapur to consider claim.

It appears that a process for appointment on compassionate basis was parallely initiated at the departmental level in the department of Panchayat and Chief Executive Officer Janpad Panchayat, Kusmi had taken up the matter and forwarded the proposal to the Zila Panchayat, Balrampur, who in turn, directed the Janpad Panchayat, Kusmi to provide appointment on compassionate basis. On 23.07.2015, Janpad Panchayat, Kusmi required the Block Education Officer, Kusmi to identify vacant post so that appointment could be provided to the petitioner. Earlier a contempt petition was moved by the petitioner against Chief Executive Officer, Janpad Panchayat, Kusmi, which was dismissed with the observation that a direction was issued to respondent No.3 in the writ petition and not to Chief Executive Officer, Janpad Panchayat, Kusmi.

3. Now fresh contempt petition has been filed by the petitioner alleging that the direction was required to be complied with by respondent No.3 in the

-2writ petition.

4. It is not known whether the proceeding of compassionate appointment at Panchayat level were initiated at the instance of Inspector General of Police, Surguja Range Ambikapur.

5. The respondent No.3, in the writ petition, namely Inspector General of Police Surguja Range Ambikapur is required to look into the mater and ensure that the order passed by this Court is complied with by providing compassionate appointment to the petitioner. Considering that the process of appointment of the petitioner is at the verge of completion and only post have to be identified by the Block Education Officer, it is directed that the Chief Executive Officer, Janpad Panchayat, Kusmi shall inform the petitioner regarding her appointment on compassionate basis. If that is not done within a period of 45 days from the date of receipt of copy of this order, the respondent in the contempt petition shall take up the matter and ensure compliance of order dated 24.12.2014 passed in WPS No.6673 of 2014. In any case, action if any required by the respondent should be completed at th earliest, not later than 45 days. If ultimately, it is found that the petitioner is not provided compassionate appointment by anyone, this Court will be constrained to initiate contempt proceedings.

6. The contempt petition is accordingly disposed off.

7. A copy of this order be produced by the petitioner before the respondent - Inspector General of Police, Surguja Range Ambikapur as also before the Zila Panchayat, Balrampur, Janpad Panchayat, Kusmi and Block Education Officer, Kusmi.
