The present M.C.C. has been filed by the Applicant seeking restoration of Writ Petition (S) No. 77 of 2017 which got dismissed on account of peremptory order issued by this Court on 9.1.2017. 2.

Learned Senior Counsel for the Applicant submits that the default pointed out by the Registry of this Court could not be carried out within the stipulated time and the same was carried out with a delay of nearly 7 days and by that time the peremptory order came into effect. 3.

Considering the reasons assigned to be satisfactory, the present M.C.C. is allowed.

Accordingly, the Writ Petition (S) No. 77 of 2017 stands restored to its original file for further consideration.

No order as to costs.
