The present Contempt Petition has been filed by the Petitioners alleging disobedience of the Order dated 5.10.2021 passed by this Court in W.P.(S) No.5429/2021.

The said interim Order dated 5.10.2021 passed in W.P.(S) No.5429/2021 was passed by this Court only to the extent that, two posts of the category to which the Petitioners belong be kept vacant till the next date of hearing.

The said Writ Petition is still pending consideration before this Court.

The only grievance of the Petitioners is that the promotion process has been finalised and the order of promotion does not reflect the Department having kept the two posts vacant in order to accommodate the Petitioners in the event of they being succeeded in the Writ Petition.

This Court is of the opinion that the stage of drawing the contempt has not been made out as of now. The grievance of the Petitioners is only that in the event if the Writ Petition which is pending consideration before this Court is allowed and the Respondents thereafter express their inability in accommodating the Petitioners due to non-availability of posts. As of now, only because the Respondents have not reflected to have kept the two posts vacant, it cannot be said to be an act of contempt on the part of the Respondents. No contempt as such is made out. 6.
