Shri H. B. Agrawal Sr. Advocate with Smt. Prabha Sharma, Advocate S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/07/2017 Heard.

1. This Court had earlier passed order dated 4.5.2017 recording the submission made before the Court that the Tribunal has become functional, however, the review petition was filed on the submission that the statement was without proper instructions and information and in fact the Tribunal was not functioning.

2. Now today, learned counsel for the parties placed before the Court, an order dated 13.7.2017 passed by the Debts Recovery Appellate Tribunal, Delhi (InCharge Debts Recovery Appellate Tribunal, Allahabad) which records that the petitioner's case would be coming up for hearing before DRAT on 9.8.2017 at Allahabad.

-23. This shows that the Tribunal is holding sitting at Allahabad. Therefore, in these changed circumstances and subsequent developments, I am not inclined to keep the matter pending. This petition is accordingly finally disposed off with a limited protection to the petitioner that till 9.8.2017, no coercive steps shall be taken against the petitioner.
