Present contempt petition has been filed alleging non-compliance of order passed by this Court in WPS No.1346/2017. The dispute relates to not calculating the leave account of a petitioner, a retired employee, properly. 2.

Pending the contempt petition before this Court today, Shri K.K.Pandey, Advocate present along with the comtemnor submits that, the authorities have recalculated the entire leave account of the petitioner and verified it with the service book and found that the petitioner herein is entitled for an additional amount of Rs.1,04,551/- and he says that necessary instructions in this regard have already been issued on 05/01/2018 by the Block

Education Officer, Akaltara and that in all probability, the amount would be paid to the petitioner very soon.

Given the submission made by the counsel for the respondent and the contemnor present in the Court and also taking the report submitted by the counsel for the respondent on record including the treasury voucher slip this Court is of the opinion that, the order passed by this Court in WPS No.1346/2017 stands purged and as such no fruitful purpose would be served in continuing with the contempt petition. 4.

The present contempt petition thus stands disposed off and the contemnor stands discharged of the contempt proceedings. 5.

However, in the event if, the petitioner finds that the calculation and the payment made by the respondent is not proper and correct, the petitioner shall have the liberty to challenge the same by way of a fresh petition bringing out the correct facts. The petitioner would also have the liberty of approaching the Block Education Officer by way of fresh representation in case if he still finds any discrepancies in calculation. Sd/- (P.
