The limited grievance that the petitioner has made is that, when the petitioner appeared for his 10th examination in the year, 2010-12, the date of birth of the petitioner has been wrongly mentioned as "29.05.1996" instead of "29.05.1996" and the father's name of the petitioner also has been entered as "Ramesh Ray Kushwaha" instead of "Ramashray Kushwaha".

The results were published in the year 2012 and in the results itself it has been categorically envisaged by the authorities of the Central Board of Secondary Education that in case of correction of date of birth as well as father's name, the request for the same has to be made promptly. The petitioner already had within the period prescribed made a request for appropriate correction to the respondent No.3 as is evident from the letter dated 18.11.2013 (Annexure P/3) attached with the writ petition. However, till date no further proceedings/development have taken place on the said correction proceeding. The petitioner prays for an appropriate direction to the respondent No.3 to expeditiously process the claim of the petitioner

-2and make necessary correction so far as date of birth of the petitioner as well as his father's name is concerned.

The said request of the petitioner seems to be fair and justified. According to the petitioner, in all other educational records and other available records, there is no dispute including subsequent educational records prepared, except for the mark-sheet of Class 10th.Therefore, the petitioner is compelled to approach the court for an early correction of mark-sheet. 4.

Given the said facts, let the respondent No.3 take an appropriate step for processing the claim of the petitioner for correction of his mark-sheet so far as his date of birth and father's name is concerned in accordance with guidelines governing the field.

Let this exercise be completed at the earliest preferably within a period of six months from the date of receipt of copy of this order. It shall be the responsibility of the petitioner to apprise the respondent No.3 so far as order passed by this court is concerned.

HIGH COURT OF CHHATTISGARH, BILASPUR Order Sheet MCC No. 1026 of 2019 Praveen Singh Kushwaha Versus The Secretary 20.11.2019 Mr. K. P. Sahu, Counsel for the Applicant.

The present MCC has been filed seeking modification of the Order dated 16.10.2019 passed in WP (C) No. 3659/2019. The modification sought for is to the extent that the name of the petitioner has been inadvertently written as "Praveen Kumar Kushwaha", whereas it ought to have been "Praveen Singh Kushwaha". Likewise in paragraph 1 of the order the Date of Birth mentioned in the mark-sheet has got wrongly typed as "29.05.1996" whereas it ought to have been "29.05.1995". The counsel for the petitioner drew this correction in the light of the documents and the pleadings made in the Writ Petition.

The limited grievance is not opposed by the respondents. Given the aforesaid facts, the present MCC deserves tobe and is accordingly allowed.

The name of the petitioner passed in WPC No. 3659/2019 in Order dated 16.10.2019 shall be read as "Praveen Singh Kushwaha" instead of " Praveen Kumar Kushwaha" and in paragraph 1 in the 3rd line the Date of Birth mentioned as "29.05.1996" shall be read as "29.05.1995".

With the aforesaid modification, the present MCC stands allowed and disposed off.
