Hon'ble Shri Justice Gautam Chourdiya Order on Board 17/12/2021

1. This Criminal Revision is filed under Section 397/401 of Cr.P.C., 1973 challenging the order dated 12.11.2021 passed by the Additional Sessions Judge, Fast Track Special Court, Rajnandgaon, C.G. in Special Case SC/ST No.19/2019 rejecting the application of the petitioners under Section 311 of Cr.P.C. for recalling of the prosecutrix.

2. Learned counsel for the petitioners seeks to withdraw this petition as he wants to file a duly constituted petition under Section 482 of Cr.P.C. He also prays for return of certified copy of the impugned order.

3. Counsel for the State has no objection to the above prayer.

4. Permission granted.

5. Accordingly, the revision petition is dismissed as withdrawn.

6. Registry is directed to return certified copy of the impugned order to the counsel for the petitioners on his furnishing true authenticated xerox of the same.
