Heard on the application filed under Section 439 of the Cr.P.C. This is second bail application before this Court filed by the applicant for grant of regular bail. His earlier application for grant of regular bail filed before this Court, MCRC No.6269/2019 was dismissed as withdrawn on 23-09-2019 with liberty to file duly constituted application. The applicant has been arrested on 22-05-2019 in connection with Crime No.25/2019 registered at P.S. - Sanawal, District - Balrampur-Ramanujganj, Chhattisgarh for the offence under Section 21B of N.D.P.S. Act.

It is submitted on behalf of the applicant that this applicant has been falsely implicated in this case. He has no criminal antecedent. The investigation in this case is now complete and he is in jail since 22-05-2019. Therefore, it is prayed that the applicant may be granted bail. 3.
Learned counsel for the State/non-applicant opposes the application. 4.
Heard learned counsel for the parties and perused the case diary. 5.
110 bottles of Phencyrex Cough Syrup were seized form the possession
-2of this applicant having content of Codeine Phosphate. Hence, this case. 6.
Considering that the case is now pending for trial before the trial Court, no purpose would be served if the applicant is kept in continuous detention, he is local resident of District Balrampur-Ramanujganj, therefore, I feel inclined to allow this application.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
