1. The grievance of the petitioner through the present writ petition is that he has been transferred from the present place of posting at Janjgir Champa to Dharamjaigarh, Distt. Raigarh.

2. The solitary grievance which has been raised is that the order of transfer has been issue inspite of model code of conduct ensuing the forthcoming Assembly election. It is the contention of the petitioner that the State Govt. has already issued an instruction not to relieve any of the employees from the present place of posting till completion of the election duty.

3. Given the aforesaid facts of the case, this court is of the opinion that if the petitioner has not been relieved till now, he may not be relieved till the completion of the election duties and the authorities would be free to relieve the petitioner immediately after the election duties are over.
