Heard on application for restoration of W.P.(S) No. 4391 of 2018. 2.

In aforesaid writ petition on 05/07/2018 three weeks' time was granted to the petitioner to remove the default. It was also mentioned that failing which the petition shall stand dismissed without further reference to the Bench. Registry has dismissed the aforesaid writ petition on 28/08/2018. 3.

Counsel for the applicant submitted that default was removed on 02/08/2018. The aforesaid application has filed on 12/10/2018 4.

Looking to the facts and circumstances of the case, the aforesaid application is allowed. W.P.(S) No. 4391 of 2018 is restored in its original number. If the default has not been already removed in the writ petition, it be removed within seven days.
