Sam Koshy Order On Board 26/10/2018 The present application under Section 438 of Cr.P.C. has been filed seeking for grant of anticipatory bail to the applicant apprehending his arrest in connection with Crime No. 19/2016 registered at P.S. BaghNadi, Rajnandgaon (CG) for the offence punishable under Sections 420, 120-B, 467, 468, 471 of IPC.

The present is 4th bail application. The first bail application was rejected on 17.05.2017, the second was on 21.06.2017 and the third bail application got dismissed on account of a peremptory order passed by this Court on 10.07.2018.

Perusal of the record would show that on 21.06.2017 when the second bail application was being considered, this Court was not inclined to grant anticipatory bail to the applicant and the bail application was disposed of with an observation that in case the petitioner surrenders and moves an application before the trial Court, the trial

Court would consider the same if possible on the same day. Though more than one year 4 months have passed, the applicant does not seem to have taken the advantage of the said order and till date he is avoiding the arrest. This Court does not find any substantial change in the development or situation for reconsidering the two orders earlier passed.

Maintaining the order that was passed on 21.06.2017 whereby it was observed that in case if the petitioner surrenders and moves an application for regular bail, the same be considered if possible on the same day, the present MCRCA stands dismissed. Sd/- (P. Sam Koshy) Judge Bhola
