This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.239/2015 registered at Police Station- Bhakhara Dhamtari, Civil & Revenue District Dhamtari (C.G.) for the offence punishable under Section 420 r/w 34 of Indian Penal Code. The first bail application was dismissed on merit on 16.11.2016. 2.
As per the prosecution case, a report was made by Indu Kumar and others that the applicant along-with other co-accused allured them to get jobs in Government Department and total amount of Rs.7,82,500/- was received from complainant and others. When the jobs were not provided the complainant filed report, thereby fraud has been committed by the applicant.

On being asked to the learned counsel for the applicant that what is the change of circumstances, no specific change of
circumstances has been pointed out to reconsider the instant second bail application; therefore, I am not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed at the admission stage itself.
