Shri Avinash Singh, PL Hon'ble Shri Justice Goutam Bhaduri Order On Board 22/11/2019
1. This application under Section 438 of the Code of Criminal Procedure has been filed by the applicant apprehending his arrest in connection with Crime No. 240/2014 registered at Police Station Ambagarh Chowki (CG) for the offence punishable under Section 420/34 IPC.
2. The earlier anticipatory bail application bearing MCRCA No.984 of 2019 was dismissed on merits on 04.07.2019.
3. Learned counsel for the applicant would submit that the applicant had filed a CRMP No.1365 of 2019 for quashment of the charge-sheet as non-bailable warrant was issued against him, however, the co-ordinate Bench vide order dated 17.06.2019 dismissed the same. This fact could not be brought before the notice of this Court.
4. Considering the fact that the earlier anticipatory bail application was dismissed, I do not find any change of circumstances to reconsider this repeat anticipatory bail application. Accordingly, the anticipatory bail application is dismissed. Sd/- Goutam Bhaduri Judge Ashu
