This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.131 of 2016 registered at Police Station- Mana, District Raipur (C.G.) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act. The first bail application was dismissed on merit on 28.09.2016 in MCRC No.5938 of 2016 on the ground that the applicant has to his credit 24 criminal cases.

Learned counsel for the applicant submits that the seizure witness have been examined, therefore, the second bail application may be considered.

Perused the earlier rejection order dated 28.09.2016. The order was passed on merit. Considering the same, I do not find any change of circumstances to reconsider this second bail application. 4.

Accordingly, the bail application is dismissed at the admission stage itself.
