For the reasons assigned in the said application, I.A. No.01 is allowed and the delay in filing the present Cr.M.P. stands condoned.

Also heard the Cr.M.P.

It has been preferred seeking for restoration of Cr.M.P. No. 998/2016 which got dismissed on account of peremptory order passed by this Court on 16.09.2016.

Counsel for the petitioner submits that as of now he is ready to cure the default within whatever period the Court stipulates and prays for restoration of the said Cr.M.P. Considering the reasons assigned in the application and finding them to be satisfactory, this Court is of the opinion that it is a fit case to allow the application for restoration of Cr.M.P. No. 998/2016.

Accordingly, the present petition is allowed and subject to the petitioner curing the default within a period of seven days from today, Cr.M.P. No. 998/2016 would be restored to its original number.

No order as to costs.
