This is second bail application filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicant apprehending arrest in connection with Crime No. 365 of 2016, registered at Police Station City Kotwali, Raigarh, District Raigarh (CG) for the offence punishable under Section 498-A, 326 (A)/34 of the IPC.

At the outset, learned counsel appearing for the applicant would submit that co-ordinate Bench of this Court has passed an order dated 6-4-2017 in respect of other co-accused Akhtari Begam in M.Cr.C (A) No. 05 of 2017 wherein prayer was accepted and other co-accused was directed to appear before the trial Court to move a regular bail and if the applicant surrenders before the court below and files an application for grant of regular bail, then the same may

be heard and decided on the same day. He would further submit that the case of the present applicant is similar to that of other coaccused, therefore, same direction may also be given to the applicant.

Perused the bail order dated 6-4-2017 passed by co-ordinate Bench of this Court.

On due consideration, it is directed that without any appreciation on its merits reserving liberty to the applicant to surrender before the concerned trial Court and shall file an application for grant of regular bail before the jurisdictional criminal court, the court shall make all endeavour to decide the regular bail application preferably on the same day, in accordance with law.
